TERMS & CONDITIONS

1. Introduction

These Terms & Conditions (“Terms”) govern access to and use of the My.Win web platform, mobile application, and related services (collectively, the “Platform”) operated by My.Win (“Company”, “we”, “us”, “our”).

By accessing or using the Platform, you agree to be bound by these Terms.

If you are using the Platform on behalf of an organization, you represent that you have authority to bind that organization to these Terms.


2. Eligibility

The Platform is intended for business use by:

  • Original Equipment Manufacturers (OEMs)

  • Food Manufacturers (FMs)

  • Resellers, vendors, and authorized partners

  • Authorized personnel of registered organizations

You must be at least 18 years old to use the Platform.


3. Account Registration & Access

3.1 Account Creation

Access to My.Win requires a registered account. Users must provide accurate and complete information.

3.2 Account Responsibility

You are responsible for:

  • Maintaining confidentiality of login credentials

  • All activities under your account

  • Ensuring authorized use within your organization

We reserve the right to suspend or terminate accounts that violate these Terms.


4. Platform Services

My.Win provides digital tools for:

  • Equipment and installation management

  • Maintenance and health check tracking

  • Service request management

  • Spare parts inquiries and RFQs

  • Partner and collaboration workflows

  • Reporting and data visibility

We may modify, update, or discontinue features at our discretion.


5. Organizational Data Ownership

5.1 Customer Data

All installation data, equipment records, service logs, and uploaded documents remain the property of the respective organization.

My.Win acts as a data processor and platform facilitator.

5.2 Usage Rights

You grant My.Win a limited license to host, process, and display your data solely to provide Platform services.


6. Acceptable Use

Users agree NOT to:

  • Use the Platform for unlawful purposes

  • Upload malicious code or harmful content

  • Attempt unauthorized access to other accounts or systems

  • Interfere with platform security or functionality

  • Reverse engineer or copy proprietary elements

Violation may result in termination and legal action.


7. Data Security

We implement reasonable technical and organizational safeguards to protect data. However, no system is completely secure.

Users are responsible for maintaining device-level security.


8. Confidentiality

Both parties agree to maintain confidentiality of proprietary information shared through the Platform.

This obligation survives termination.


9. Intellectual Property

All software, branding, logos, designs, documentation, and proprietary technology associated with My.Win are owned by the Company.

No rights are granted except those expressly stated in these Terms.


10. Subscription & Payments (If Applicable)

If your organization subscribes to paid services:

  • Fees are governed by a separate commercial agreement

  • Non-payment may result in suspension

  • Fees are non-refundable unless otherwise agreed


11. Third-Party Integrations

The Platform may integrate with third-party tools. My.Win is not responsible for:

  • Third-party services

  • Their availability

  • Their data practices

Use of third-party services is at your own risk.


12. Limitation of Liability

To the maximum extent permitted by law:

  • My.Win shall not be liable for indirect, incidental, or consequential damages

  • Total liability shall not exceed the amount paid by your organization in the preceding 12 months

The Platform is provided “as is” without warranties of uninterrupted service.


13. Termination

We may suspend or terminate access if:

  • Terms are violated

  • There is security risk

  • Required by law

Upon termination:

  • Access will cease

  • Data retention will follow applicable agreements


14. Governing Law

These Terms shall be governed by the laws of [Insert Jurisdiction, e.g., India / Singapore].

Disputes shall be subject to the exclusive jurisdiction of courts in [Insert City].


15. Changes to Terms

We may update these Terms periodically. Continued use of the Platform constitutes acceptance of revised Terms.
